AN ACT to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §18-10O-1, §18-10O-2, §18-10O-3, §18-10O-4 and §18-10O-5, all relating to increasing the awareness and understanding of the history and contributions of people with disabilities in the state, nation and world; designating the third week of October as Disability History Week for the state of West Virginia; requiring integration of instruction on disability history, people with disabilities and the disability rights movement into the existing public school curriculum; legislative findings; and defined terms.
A BILL to amend chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new article, designated article ten-l, relating to the creation of the "Ron Yost Personal Assistance Services Act"; requiring a program to provide personal assistance to certain impaired individuals; outlining legislative policy; designating the West Virginia statewide independent living council as the organization responsible for the establishment of the program; requiring proposal of rules; requiring annual reports; and providing for continuation of the program.
A BILL to amend chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new article, designated article ten-m, relating to establishing the statewide independent living council; providing for the powers and duties of the council; providing for a state plan for the provision of independent living services to people with disabilities to be jointly developed by the council and the division of rehabilitation services; providing that available funding for independent living services shall be administered by the division of rehabilitation services; and specifying funding eligibility criteria for centers for independent living.
AN ACT to amend the code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5A-1-11, relating to creating the position of state Americans with disabilities coordinator within the department of administration; powers and duties; authorizing assessing fees to other state agencies for the coordinator's services; creating special fund; annual report; and sunset provision.
AN ACT to amend chapter forty-six-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new article, designated article six-e, relating to providing consumer protection regarding assistive devices; definitions; warranty requirements and remedies; lease enforcement; required disclosures; arbitration; and actions for damages.
A BILL to amend chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new article, designated article ten-j, relating to requiring that the individualized education program of each blind or visually impaired child includes provisions for instruction in braille and the use of braille appropriate to the child's current and future literacy needs; establishing standards of proficiency and instruction; providing materials in a computer-accessible format capable of braille reproduction; and requiring the certification of teachers in accordance with braille literacy standards.
AN ACT supplementing, amending, reducing and transferring an item of the existing appropriation to the department of health and human resources, division of health, central office, account no. 0407, fiscal year 1997, organization 0506, to the department of education and the arts, state board of rehabilitation - division of rehabilitation services, account no. fund 0310, fiscal year 1997, organization 0932, as originally appropriated by chapter eight, acts of the Legislature, regular session, one thousand nine hundred ninety-six, known as the "Budget Bill".
AN ACT to amend chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new article, designated article ten-i, relating to providing supported employment services to persons with disabilities through the West Virginia division of rehabilitation services; setting forth findings; defining terms; establishing a model supported employment program; specifying services which may be provided under the program; setting forth eligibility criteria; setting forth the eligibility requirements and primary focus of the program; and providing for the administration and implementation of the program.
